摘　　要：任何科学都与人性有关 ,经济法与人的科学的关系更为密切。经济法基于经济人的人性缺陷造成市场失灵而得以产生。道德人理念是经济法建构的人论基础 ,经济法的理念、价值取向、基本原则、制度都是建立在道德人理念之上的。政府完全道德人假设明显不具有现实性和合理性 ,政府干预失败是政府完全道德人假设破灭的逻辑结果。Any Science is related to human nature. Economic law is more closely connected with human nature. The limitation of economic men in human nature makes the market unable to work properly, and thus economic law is emerged. The idea of moral men is the basis of human nature in the course of formulating economic law. The ideas, values, principles and system of economic law are based on the idea of each moral man. It is an unrealistic and unreasonable hypothesis that government staff is believed to be absolutely moral, which results from the failure of governmental intervention.
