摘　　要：中国已进入法治时代，国人正普遍关注“沉默权”能否在我国确立。我国已加入WTO，与世界政治、经济、文化的交往不断增多，法律上要与国际通行原则接轨，履行国际义务、遵守国际条约则是必然的。从履行国际义务、遵守国际条约的角度出发，实行沉默权亦是必然的。而沉默权作为公民的一种权利，用法制来保护民主权利是他们的心声，也是时代的召唤，社会的主旋。Since China has entered a legal era,the establishment of right of remaining silent in China has aroused general con-cern.With our en try into the WTO,we have more contacts with other countries in politics,economics and culture,hence our laws should be geared to the international conventions.From the angel of fulfilling the international obligations and abiding by the international treaties,it's also in evitable to estab lish right of remaining silent in China.As a right of citizens,it voic es the aspira tions of people who want to guarantee their demo cratic rights by legality.
