A Preliminary Probe into the Relative Party of Administration

摘　　要：行政法理论和实践都将着眼点放在“行政主体”和“行政相对人”上,忽略了另一部分人———行政相关人的存在。行政相关人不是具体行政行为指向的对象,但受到具体行政行为的影响;现行立法、司法实践对其缺乏有效的保护机制,使其合法权益经常受到侵害,应切实加强对行政相关人合法权益的保护。Both the theory and the practice of administrative law focus on “the subject of administration” and “the opposite party of administration”, ignoring the existence of another sort of interested party—the relative party of administration. Though not the object of a concrete administrative act, this third party is in no doubt affected by the act. However, contemporary legislative and judicial practice lack effective protection measures for the relative party of administration, which often results in much infringement upon its legal rights.
