摘　　要：好意施惠是一种旨在增进情谊的行为,但在实践中由其引发的纠纷也时有发生。由于好意施惠具有无偿性且出于良好的动机,此类纠纷的处理也应该有一定的特殊规则。然而这似乎并没有引起我国法学界的重视,对于好意施惠行为的性质、当事人之间的关系及如何处理其引发的特殊纠纷,尚没有全面深入的研究,在实践中必然导致一些问题。以好意施惠行为的性质为基础,分析我国民法的现行相关规定,以期构建好意施惠引发纠纷的处理规则,对理论研究和实践有一定的借鉴意义。Although Gefalligkeitsverhaltnis aimes at promoting friendly feelings, it also gives rise to many disputes. Because of its gratuitous nature and good purpose, special rules should be applied when dealing with the very kind of dispute. However, it doesn't draw enough attention in the law realm, there aren't thorough studies on the nature of Gefalligkeitsverhaltnis, the relationship between the parties, the settlement of the disputes. Based on the nature of Gefalligkeitsverhaltnis, this paper analyzes the current relevant regulation, expecting to establish the rules to deal with such disputes and to benefit the theoretical study and practice.
