论社会保障法的基本价值取向

摘　　要：理论界较一致地认为 ,社会保障法的基本价值取向是公平与效率。根据公平与效率的基本含义 ,对社会保障法的公平、效率价值观予以考察 ,却发现社会保障法的基本价值取向既不是公平 ,也不是效率。从社会保障的语义、社会保障法的产生动因及社会保障法的基本属性分析 ,社会保障法的基本价值取向应该是安全 ,包括个人生活安全与社会安全。Most of people in the theoretical circle think the fundamental value of social security law is fairness and efficiency. After a st udy of the definition of the words “fairness' and “efficiency' and analysis of the view that the fundamental value of social security law is fairness and efficiency, this paper holds the view that the fundamental value of social se curity law is safety, including safety of individual life and safety of society after the study of the meaning of “social security”,the motive and the attri butes of social security law.
