从中美俄三国在《京都议定书》的态度上看共同但有区别责任原则

摘　　要：经过艰难的谈判妥协,各缔约方终于制定了《京都议定书》。为了促进其尽早生效,中国很快核准了《京都议定书》,而美国在签署之后又予以反悔,这是对作为国际环境法基本原则之一的共同但有区别责任原则的破坏。所幸的是,俄罗斯态度明确,有力的维护了共同但有区别责任原则。针对中美俄的不同立场,对共同但有区别责任原则的影响,提出了推动该原则实施的途径。Compromising through difficult negotiation, every contracting party has made “Kyoto Protocol”finally. In order to promote it to come into force as soon as possible, China has checked and approved“Kyoto Protocol”quickly, while U.S. A goes back on it’s word after signing, which violated the Principle of Common and Separate Responsibilities——one of fundamental principles of international environmental law. Fortunately, Russia’s clear attitude safeguards strongly the principle. This essay analyses different positions of China,U.S. A and Russia and the influence on Principle of Common and Separate Responsibilities, puts forward the way of promoting this principle to be implemented.
