摘　　要：介绍西方法律及我国古代律例中对证人拒绝作证权的规定,分析该项制度的学理价值和社会价值,从理论和实践的价度论证证人拒绝作证权制度的重要意义,并提出了在我国建构证人拒绝作证权的设想。This paper introduces stipulations of the silence right of witness in foreign laws and the Chinese ancient laws, and analyses the value of the system, demonstrates the importance of the system from theory and practice, and puts forward some suggestions for the system.
