从主诉检察官到检察官——对检察人员分类改革的思考

摘　　要：由于主诉检察官办案责任制这一改革定位不准,缺少配套的制度支持,造成这项改革限于起诉部门内部推行,无法冲破旧有的行政管理体制束缚。改革和完善检察官制度的基本目标是:以确保依法独立行使检察权为中心,依据检察官的职位特点,合理确定检察官的员额比例、职务层次,制定和完善检察官职位规范,逐步形成科学、完备的检察官管理体系。Absence of assorted systematic support of responsibility system of presiding prosecutor causes the fact that this reform could not exceed the restriction of existent administrative management system and only be exerted within the public prosecution department.The fundamental purpose of reforming and completing the prosecutor system is:with focus on independence of procuratorial power complying with the law,according to the functional characteristics of the prosecutor,reasonably determin- ing personnel proportion and functional grade of prosecutors,constituting and completing the status of prosecutor,and gradually forming a scientific and mature prosecutor administration system.
