对修改现行《治安管理处罚条例》的几点思考

摘　　要：为适应社会治安形势发展和实现法制统一的需要,亟待对现行《治安管理处罚条例》予以调整、规范和完善。将《治安管理处罚条例》更名为《治安管理处罚法》;在修改时应遵循现实针对性与较强前瞻性相结合的原则,实体与程序并重的原则,遏制权力滥用与尊重、保障人权的原则,法制统一的原则以及民主与集中相结合的原则。It is urgently necessary to do some adjustment, standardization and improvement for the existing Security Administration Punishment Act in order to fit in with the needs of the developed public security situations and realize the legal unification. It is therefore proposed to amend the Security Administration Punishment Act and rename it to Security Administration Punishment Law. And we should keep to the following principles: the principle of combining both realistic pertinence with the long-term outlook, the principle of paying equal attention to substantiality and procedure,the principle of limiting power abuse and respecting and protecting human rights,the legal unification principle and the principle of combining integration with centralization.
