论法官职务监督与法官独立  

On the Judge's Independence and Duties regarding Judges

摘　　要：法官独立是为了追求审判合乎公平正义,以保障人民权利,并给予法官身份上的充分保障,但是法官独立制度并非授予法官特权,使法官不受任何监督,法官的独立是相对的,为了保障审判的公正性,对于法官必须进行必要的职务监督。但对法官进行职务监督只能在一定范围内进行,并且要保障监督部门与惩戒部门的分离。In order to pursue the fairness and justice of the trial to guarantee people's rights, we have thus established the judge's independence system, and judge's identities have been given full protection. However, the judges are not authorized any privilege by the judge's independent system to prevent them from any surveillance, so judge's independence relatively stands. To guarantee the fairness of trial, we must carry out the essential surveillance duties regarding judges, but it is only conducted within a certain range. And meanwhile we must also guarantee the separation of surveillance department from disciplinary punishment department.
