摘　　要：让与担保为非典型担保方式。近年,其在现实经济生活中发挥着较大的作用。但是否将其规定在物权法中争议较大。通过将让与担保与动产抵押和质押比较,再从让与担保的功能、特点、性质以及我国的担保物权的发展趋势出发,论述了让与担保在物权法中有着较大的生存空间。Transferring guarantee is a kind of nontypical guarantee. In recent years, it has played an important role in economic life. However, it is controversial as to whether transferring guarantee ought to be codified in the Property Law. This thesis(author) argues that the transferring guarantee has better prospects in the Property Law than ever through 1) comparing transferring guarantee with chattel mortgage, pledge, and 2) examining the functions, characteristics, and nature of transferring guarantee, and the trend of security interest in our country.
