关于刑事回避制度的改进探析

摘　　要：在改进我国刑事回避制度时,整体回避问题宜通过管辖变更制度的完善来解决;申请回避实施程序中的举证责任问题可通过借鉴无因回避制度来解决;违反回避制度的程序性规制问题要坚持区别对待的立场。At the time of our country improving the Challenge System in Criminal Proceeding, the problem of whole challenge can be solved by the change of jurisdiction system, another problem,—how to distribute the burden of proof in the procedure of the challenge system that is motivated by the party,by learning something from the non-reason challenge system, once more, the problem of the procedural control of disobeying the challenge system by taking different attitudes according to different conditions.
