摘　　要：小额诉讼程序比传统简易程序更加简化,它以日常化方式进行,并体现了对职权裁量法理的适用。设立小额诉讼程序有一定的法理基础,我国现有简易程序存在诸多不足,无法满足小额纠纷解决之需要。在我国构建小额诉讼程序应明确其适用范围和管辖法院,同时亦应当设立小额诉讼程序的一些特别规定。The small lawsuit procedure is simpler than the traditional procedure.It goes on in adaily way and reflects the adaptation of authority judgment.Setting up small lawsuit procdeure needs certain legal principle foundations,but the exising simple procedure of our country still carries many weakpoints,which are unable to meet the need of the small dispute's resolution.To structure the small procedure in our cuntry,its scope of application and administration court should be defined.Meanwhile,some special regulations of the small lawsuit procedure should be also set up.
