影响精神发育迟滞女患者性自卫能力评定的非智力因素分析

摘　　要：目的探讨患精神发育迟滞的女性被鉴定人在司法精神鉴定中,可能影响其性自卫能力评定的非智力因素。方法对符合中国精神障碍分类与诊断标准第3版(CCMD-3)精神发育迟滞诊断,检查中发现智力水平与性辨别能力有矛盾的女性被鉴定人57例及其家人和办案人员进行自制问卷的调查。结果家属对案件的态度25 例(43.9%)及延误报案时机18例(31.6%),被鉴定人受外界因素的影响程度43例(75.4%)和与智力不相称的学历水平13例(22.8%),询问笔录的真实性21例(36.8%)等因素,均可能影响司法精神鉴定人员对其性自卫能力的评定,这些影响因素均呈现一定的特征。结论被鉴定人家属及办案人员对待案件的某些态度和行为等,可能构成影响一些精神发育迟滞女患者的性自卫能力评定的非智力因素,须注意进行识别、排除。Objective To explore non-intelligence factors which affect assessment at appraisement of forensic psychiatry on the sexual self-defense capacity for female patients with mental retardation. Methods Using self-made questionnaire for 57 female patients with mental retardation according to 《CCMD-3》 whose level of intelligence were in conflict with their sexual self-identification capacity, family members and officers engaging cases. Results There were some instances that may influence appraisers making assessment on sexual self-defense capacity for clients during appraisal of forensic psychiatry, such as the attitude of cases for their family members(43.9% ), the delay of reporting cases to the security authorities for their family members(31.6%), influence degree by outsider factors to clients(75.4%), clients' educational background with the disproportionate level of intelligence (22.8%) and the fact of enquiry notes(36.8%). These influence factors showed some characteristics. Conclusions Some attitudes and behaviors of clients' family members and officers engaging cases may constitute non-intelligence factors which will affect assessments on the sexual self-defense capacity for female patients with mental retardation. Appraisers need pay attention to identification and exclusion.
