论如实供述义务——兼论英国限制沉默权的可借鉴性

摘　　要：犯罪嫌疑人、被告人如实供述义务,作为一种普遍性的法律规定,在现代刑事诉讼中遭遇到多种规则与制度的挤压,比较我国与英国的相关规定,可以看出不同的实效和对之截然相反的价值评判。因此,笔者主张保留并改造我国的如实供述义务,将其特定化或个别化从而置于沉默权的前提之下。As a general legal provision,the obligation of truthful statement of criminal suspect or defendant has encountered ex- trusion from various regulations and systems.Compared relevant prescription of China with that of the UK,completely contrary value judgment and distinct substantial results may appear.Therefore,the author maintains that the obligation of truthful state- ment shall be retained while rebuilt to be a specific or exceptional obligation under the right to silence.
