摘　　要：执行异议制度是执行救济程序中的核心内容,对维护当事人的合法权益、保障执行的公正、效率意义重大。然而,我国的执行异议不仅性质混乱,程序规定也不具体,不能发挥其程序性救济的重要作用。本文通过对现行执行异议制度的分析检讨,确定了执行异议的性质,并通过对其他国家和地区的比较分析,初步设想了我国执行异议制度的重塑方案。The execution objection system is a center part of the execution relief of procedure, which is important to pretect the leigitimate rights of clients, and to guarantee fair and effectiveness of the execution. However, in our country, the execution objection not only the quality is confused, but also the stipulation is not concretely, which can not develop the important effect of the procedural relief. This paper define the quality of execution objection by analyzing the currently execution objection system, moreover, by means of the comparing analysis to else country and area, assuming preliminary the mold plan of the execution objection in our country.
