提单管辖权条款的法律效力问题刍议

摘　　要：文章在对提单背面管辖权条款的法律效力进行分析的基础上,首先介绍了英国、美国等航运大国对待提单管辖权条款的态度及做法,然后就我国相关法律法规的规定和法院在实践中的做法进行了阐述和分析,最后针对我国司法实践提出了自己的看法。On the basis of analyzing the legal effect of the jurisdiction clause in bill of lading, the article firstly introduces the position taken by England, America and some other countries and the way they adopt towards the jurisdiction clause. Then, it elaborates and dissects the prescriptions of Chinese legislation and regulations as well as the way taken by courts in practice. Finally, the author puts forward some views and suggestions on the practices of courts in China.
