论证据法上的诚信

摘　　要：通过对涉及证据规范的实体法和程序法的归纳,以及对于两大法系证据规范的对比总结,特别是对当今世界诉讼程序的现状和发展趋势的分析,可以肯定,在现代自由心证证据制度下,诚信观念将成为法官审查、判断证据的内心准则,是证据法的核心精神。Based on the induction of related substantial law and procedural law of proof, along with the comparison of rules between Continental law system and Common law system, especially the analysis on the current situation as well as the trend of litigious procedure in the World, the author holds that under the discretion, the ideal of bona fide has become the inner criterion of a judge when he examines or determines a proof, that is the core spirit of proof law.
