高校内部学生管理规范的合法性研究

摘　　要：目前高校内部学生管理规范存在诸多合法性问题,应引起高校管理实践者和理论工作者的重视。对涉及基本人权、受教育权等重要事项,应以法律优位和法律保留原则进行规制,另外高校要改变以规范和约束为主的管理模式,树立“学生消费者”理念,在重视学生实体性权利的同时,确立正当程序原则。In present colleges and universities, there widely exist some legal problems in the students management work, which those who are practicing and doing theoretical work should attach great importance to . The critical items concerning human rights and the rights of being educated should be legally regulated on the basis of law—priority and law—preservation. Colleges and universities should change its managerial patterns of regulating and restricting their students, and form the idea of “students as consumers”. They should establish the reasonable procedural principles while value the right of students’ entity.
