论民事诉讼非法证据排除规则之建构

摘　　要：建构非法证据排除规则是证据合法性、可靠性以及法律真实的必然要求。为保护公民的基本权利,适应民事审判方式改革以及现代科技的发展,我国应当结合司法审判实践经验并借鉴国外的成熟做法,建构民事诉讼非法证据排除规则。Lawfulness and feasibility of evidence require the construction of exclusive rule sof illegal evidence.In order to safeguard citizens' fundamental rights as well as to meet the need sof the reform of ways of trial in civil procedure and new development in science and technology,China,making reference to judicial practice and established proceedings in foreign countries,should construct exclusive rules of illegal evidence in civil procedure.
