摘　　要：第三人精神损害赔偿是精神损害赔偿制度的重要组成部分,国外对此有一定的研究,我国对该方面的研究与立法都很不完善,在制定侵权行为法之际,对第三人精神损害赔偿的构成要件进行分析,对完善我国的侵权损害赔偿制度,无疑具有重要意义。The indirect mental distress makes an important part of the mental distress system. The study on it abroad has reached a certain degree, while both study and legislation on mental distress in China are not consummate at all. This paper aims to make a tentative study on the constitution of indirect mental distress on the basis of foreign legislations and judicial practice. Undoubtedly, when constituting tort laws, the analysis of indirect mental distress will have a significant meaning in consummating the tort and damage compensation system.
