侦查阶段律师辩护问题浅析

摘　　要：犯罪嫌疑人享有辩护权是国际社会普遍认同的一项基本人权,获得律师帮助则是犯罪嫌疑人为自己辩护最为直接和有效的方式,律师帮助是防止国家权力侵害个人权利的最为理想的屏障。在侦查阶段律师的有效介入,能够使犯罪嫌疑人充分理解其诉讼权利,避免实定权利与行使权利脱节,有利于平衡对抗双方力量,避免犯罪嫌疑人与侦查机关力量的过分悬殊。That the crime suspect enjoys the right to counsel is one basic human right which the international social universally approval, obtains attorney＇s help is the most direct and effective way in which crime suspect defends himself, attorney helps is the most ideal barrier to prevent the state power violate the individual right. In the detection stage attorney＇s effective involvement, can make the crime suspect fully understand its lawsuit right, avoid the right which really decides with exercises comes apart, is advantageous to the balance of both resistance sides＇ strength, avoids the crime suspect and the detection institution strength is excessively disparate.
