摘　　要：动产抵押权的善意取得符合现代民商法促进交易安全与快捷的价值取向和动产占有的公信理论。无权处分人与第三人订立抵押合同时以担保债权为目的、抵押合同合法有效、第三人主观上为善意、抵押物是抵押人合法占有的动产等四个方面是动产抵押权善意取得的构成要件。动产抵押权善意取得必然在原权利人、无权处分人与善意第三人之间产生相应的法律效力。合理配置原权利人与善意第三人之间的权利和义务是动产抵押权善意取得法律效力的关键。Making a mortgage with the third part, unauthorized disposition person must have a purpose which ensures the claim with creating the mortgage;the mortgage contract is effective ; the third party is in good faith ;the things of mortgage is a movable property owned by the mortgager with an effective juristic act. These four points are the elements of the innocent purchase of the mortgage on movables. The innocent purchase of the mortgage on movables will bring forth the relevant force of law among the owner of right of disposing ,unauthorized disposition person and the third party acting in good faith. It is very important to the force of law of the innocent purehase of the mortgage on movables to dispose the right and the duty between the owner of the right of disposing and the third part acting in good faith.
