摘　　要：业主自治体制存在的缺陷、业主委员会主体资格上的法律困境及业主自治管理实际工作中存在的问题已成为业主自治发展道路上的阻碍,完善立法管理制度并鉴借外国的先进经验,是解决这些问题发挥业主自治管理制度的有效途径。The existing weakness in owners autonomous system and the legal dilemma of the subject quality of the owners committee and the problems in the practical work of owners autonomous management have all formed the obstruction on the road of owners autonomous development. The effective way to solve the problems and bring owners autonomous management into full play is to perfect legislative management system and hearn from foreign advanced experience.
