摘　　要：死刑复核程序作为我国独具特色的程序制度,在严格适用死刑,防止错杀、滥杀,保障被告人权利和打击犯罪等方面都具有极为重要的作用,是为了保证死刑质量而设置的最后一道程序保障。然而在实践中,无论是在立法、司法、还是理论中,都产生了一些不容忽视的问题,导致难以圆满实现设立的初衷,因此,有必要加以修改和完善。Procedure of judicial review of death sentence is a special procedure in the Chinese procedure law. It plays significant role in death sentence, avoiding false death sentence, abusing death sentence, and striking crimes and so on . It is the last safeguard that ensures lawmaking and judicatory. But in the theory there are many problems that can＇t be neglected, which result in not being able to realize the original intention of the procedure. So it should be amended and improved in the future.
