摘 要:扣船制度是解决海事争议的最重要手段之一,在我国主要用于海事请求保全,而美国的扣船制度又颇具特色,不但用于对人诉讼,还用于对物诉讼。目前规范美国扣船制度的主要是美国联邦民事诉讼规则.海事诉讼补充规定和一些判例。扣船制度有利于尽早查明诉因,迫使对方的当事人及早现身提供担保以解除扣船,能有效保障海事请求人的合法权利,促进纠纷解决。Arrest of Ship System is one of the methods to solve maritime dispute and is mainly used in preservation of maritime claims in China. The Arrest of Ship System of the United States has its characteristics and is suitable for human litigation and object litigation. Currently, the norm of Arrest of Ship System of the United States is mainly Maritime Litigation Supplementary Regulations of Federal Rules of Civil Procedure and some cases. The Arrest of Ship System can help to ascertain the cause of arrest of ship in order to make the parties appear to provide guarantee for solving the arrest of ship and can protect the legal rights of maritime claimers to promote the solution to dispute.
