摘　　要：经营活动中第三人侵权的责任分担应具体分析,合同明文规定构成违约责任,合同没有规定但经营者有过错的可以构成违反安全保障义务的侵权责任,在特殊情况下还可依公平原则确定责任。We should analyse specifically the responsibility division of the third party inftingement in the operating adctivity： some are specified clearly in the contract; some are not specified in the contract but the operator＇ s misdeed may constitute the infringement responsibility by breaching the security obligation. Under certain circumstances we can determine the responsibility according to the fair principle.
