摘　　要：版权法意义中的公共领域是各种与私人领域相对的、服务于社会公众的公共教育组织或机构，包括公益性信息服务机构、公共管理组织及大众媒体等。各国为维持个体利益与，公共利益的平衡，大都规定了公共领域使用版权作品的“例外”与“免责”、即合理使用。公共领域必须充分尊重版权人权利，严格把握合理使用的尺度。以图书馆为代表的公益性信息服务机构必须以服务社会公众为目的，遵守版权作品使用数量的规定；公共管理活动行为主体必须得到严格限定；大众媒体在非营利的基础上，还要注意其使用行为对版权作品市场的潜在影响。The meaning of public field in the copyright law is what are opposite to private field, serve the public ＇s public educational organizations , including the information service organization of public welfare, managing the activity and Volkswagen media, etc. publicly . In order to keep balance of individual interests and public interests, various countries stipulate public field using copyright ＂exception＂ of message and ＂avoid the reeponsibility＂ . namely use rationally. rationally strictly , The information service organization of public welfare represented the quantity of the copyright woeks, The public management activity behavior subject must be limited strictly. Masses media on the non-commercial basis, should also pay attention to its using behavior＇s potential impact to copyright woeks market.
