摘　　要：在司法实践中公平原则越来越多地被应用到医疗侵权民事诉讼案件。针对这一情况,分析医疗纠纷的司法环境,并提出按照规章办事,把握法律底线;实施风险评估,科学合理诊治;区别对待赔偿,保护员工权益;完善保障体系,构建和谐社会等应对措施。In law practice fair principle is applied to medical civil indict more than before.Aim at the condition in this article the judicatory circumstance of malpractice was analyzed, then doing according to the rule to hold the law principle, evaluating the medical risk to guide diagnosis and treatment;distinguishing the lose to protect staff right; improving safeguard system to build harmonious society were recommended.
