摘　　要：诉讼救助制度是保障当事人接近正义的客观需要,也是当事人的一种诉讼权利。我国应建立相应的司法救助申请救济制度,对于驳回的司法救助的申请应允许当事人上诉。The judicial relief system is a hot issue, the author introduces the conception of the civil litigation fee and try to analyze the judicial relief system in Japan and China. Finally, the author gives some suggestions on the judicial relief system in China.
