摘　　要：设立证据排除规则的法理基础是保障查明案件真实,以更好的保障人权及维护社会其他利益,保障人权及维护社会其他利益是查明案件真实的目的,查明案件真实是保障人权及维护社会其他利益的手段,因此,法律应当设立一种制度来保障人权及维护社会制度,这种制度即特权规则。The legal base of establishing evidence--removing rule is to guarantee the security of the case so as to secure the human rights and other social interest. The security of the human rights and other social interest is the aim of verifing the case reality and verifing the case reality is the means of securing the human rights and other sociai interest. Therefore, a system in law, the privilege rule, must be set up to safeguard the human rights and maintain social system.
