证据之王情结的思考

摘　　要：人们将某一时期,具有突出证明作用的证据称为证据之王。从口供到DNA指纹术,其后隐藏着对神和科学的权威崇拜情结。盲目的迷信只能增加对证据之王的依赖性,科技时代不仅需要先进的技术,更重要的是思考如何构建科学证据使用标准和规则,如何确立庭审阶段对这些证据质证、认证规则,构建辅助控辩双方、法官准确认定事实的专门证人制度,以正当程序来确保审判的公正与准确。People call the evidence the king evidence that plays an outstanding certifying role at a certain period of time. From testimony to dactylography, there hides behind them the authority worship complex of the deity and science. Blind superstition only fosters reliance on the king evidence. In the times of science and technology, not only are advanced techniques needed. What is more significant is the consideration of the establishment of criteria and rules for the aplication of the scientific evidence, of the establishment of the rules for questioning the witness about and attesting the evidence in the court stage and of the establishment of the system of special witness who helps the accusing party, the defence party and the judge to accurately affirm the fact so that proper procedure will ensure aft impartial and accurate trial.
