摘　　要：死刑复核程序作为刑事诉讼的一项特别程序,在保障正确适用死刑,纠正和防止发生失误方面发挥了重大作用。然而,目前的立法和司法实践中,这一程序仍然存在明显的问题,有待于进一步研究和完善。死刑核准权问题是死刑复核程序的核心问题,最高人民法院应收回死刑核准权;规范死刑复核程序的审理方式;明确死刑复核程序的审理期限。As a special process of criminal prosecution, the death penalty regulating procedures play an important role in correcting and preventing mistakes in the application of the proper use of capitol punishment.However, in current legislation and the administration of justice, problems still exist in regulating and applying the death penalty, which should be further studied and perfected, so that justice is properly secured. Confirmation of death penalty is the core of death penalty regulating procedures. The highest court should withdraw the right of death penalty confirmation, standardize the form and explicit the expiry of the death penalty regulating procedures.
