论柔性契约与垄断结构企业模式

摘　　要：新经济时代企业组织的主导形式开始由纵向一体化向横向一体化转变,越来越呈现出柔性化、模块化、虚拟化等特点。企业是一系列契约的联结,企业组织形式的改变使得作为规制企业内部或企业之间各种关系的契约安排发生了相应变化。基于此背景,我们提出了柔性契约的概念,初步探讨了柔性契约的理论来源和构成要素,并从企业的契约角度对垄断结构企业模式进行了相关研究。In the era of new economy,the leading pattern of enterprises＇ organization has started to change from vertical integration to horizontal integration,which takes on the characteristics of flexibility,modulization, virtualization,etc. Enterprises are made up of a series of contracts,the change of enterprises＇ organization brings about the corresponding alteration of contractual arrangements,which are used to regulate all kinds of relations among or between enterprises. Upon the background,we put forward the concept of flexible contract,preliminarily explore the theoretical origin and components of flexible contract,and we also carry out the relational research on enterprises＇ monopoly structure mode through corporative contracts.
