摘　　要：法哲学流派对合同法有一定的影响,如自然法学重视个人的自由并主张当事人之间的合同相当于法律的效力。实证法学在此基础上,强调合同法的逻辑性。新自然法学根据社会发展的需要,提出了诚实信用理论。而社会法学则注重个人和社会利益的均衡,剖析这些理论可以使我们更深刻地理解合同法的过去与现在。The article attempts to provide a more clear understanding of the past and present of contract law through the elementary instruction of legal philosophy schools that influence the contract law. Natural jurisprudence respects the freedom of human and argues the contract is law. On the base of theory, positivism jurisprudence argues the importance of logic of contract law. New natural jurisprudence expounds the theory of doctrine of good faith. Sociology jurisprudence argues the balance between society and individual.
