摘　　要：为了解决高校校方和学生之间因为不当处分而产生的纠纷,保护学生的合法权益,就要从法律的角度出发,在实体和程序两方面重构学生处分制度,以期达到公平正义,实现依法治教、依法治校的目标。In order to avoid the clashes between students and the leadership because of the improper punishment, and to safeguard the legal right of the students, the writers of the paper perform the legal research, in both entity and procedure, of the reconstruction of the penalty system of the undergraduates, for the sake of justice, fairness, legal monitoring of the teaching and schooling.
