摘　　要：在医疗侵权的证明过程中,应建立以科学性为主导的证明标准,并以相应的医学理论和经验作为法律判断的参照标准,限制当事人和法官的随意性,使医疗侵权成立、不成立和真伪不明得以正确区分,即公平地认定医疗侵权的同时也为社会保障的风险分担奠定基础。In the judgement process of medical tort, it is necessary to establish science orientated criteria make the judgement according to the reference criteria originated from the medical theories and experience, distinguish the true, false and underdetermined outcome in court adjudging and restrict judgement at random litigant and judge.In this way, we not only affirm medical tort fairly but also lay a foundation to share rish of social of proof, so as to raised by security.
