论民事再审制度改革的价值转变

摘　　要：我国的民事再审制度改革势在必行。改革的前提和基础是实现科学的价值选择和转变。在改革的价值取向上要实现从公权主导向尊重当事人意思自治的转变,从职能纠错向再审之诉转变,从诉审混同向诉审分离转变,从无序再审向维护裁判的既判力和正当性并重转变,从审判监督向程序救济转变。Under the present situation, the reform in civil reconsideration system is imperative. The supposition and the base of the reform is the scientific achievement of the value choice and its change. As far as the value tropism of the reform concerned, achieve the change from the lead of the civilian rights to the respect of the party's governance, from the functional correction to the reconsideration litigation, from mixed litigant consideration to split litigant consideration, from the disordered reconsideration to the maintain of the judged judge and the equality of justice, from adjudgement supervision to the program relief.
