确立我国沉默权制度的构想

摘　　要：沉默权,(The Right To Silence)作为一项自然权利,是否适用于中国,学术界褒贬不一。笔者认为,不论从沉默权存在的合理性还是从维护司法公正、遏制刑讯逼供的积极作用考虑,都当根据我国的实际情况,在有所限制的条件下适用沉默权,顺应世界刑事诉讼制度发展的总体趋势。Whether the right to silence as a natural right is suitable in China is spoken ill of in China. The author thinks that whether from the ration of its existence or from its legal justice, the right to silence can be used under certain restrictive conditions so as to follow the general trend of the development of the world＇s criminal lawsuit system.
