摘 要:高校人事代理是高校人事制度改革的一种尝试。1995年以来,伴随着全国高校人事代理实践的展开,其理论研究也在不断深入。但是,目前高校人事代理学说纷呈,实践形式多样,人事代理关系非常混乱。在对其梳理和整合的基础上,提出了人事代理梯级分界的观点:人事代理与聘用合同的分界和人事代理内部代理与委托的分界。指出在诸多的代理形式中,只有高校单独委托和受聘人分别与代理机构和高校签订代理和聘用两份合同两种形式比较规范,值得提倡和推行,其他形式因其自身的缺陷不宜继续采用。The employee's agency of universities and colleges is a try of the personal system reform of universities and colleges. Since1995, it develops very fast. With the quick growth of it, its researches are going deep into. But at the present, on it are there a variety of views, it is diversified in form, and it is in great disorder. Through sorting it out, we advance a new view of the stairs boundary on it : the first boundary between the employee's agency and the engaged contract, and the second one between Point out that among its forms, only universities and employees'sole the agent theory and law, worth a encouragement and carrying out ,the authorization and agency inside it. entrusting the tasks to the agent can meet the other forms should not be continuously adopted because of their defects.
