摘　　要：本文介绍美国FCC针对电信产业采取UNE规制政策的实践及目的，介绍并分析政策失败的原因。从UNE的规制实践来看，采用指令手段强制在同一市场进行竞争的双方进行不情愿的合作，最终难以达到促进竞争的目的。过分的规制难以奏效，只有解放并依赖市场力量，才有助于竞争局面的形成。针对UNE的失败，本文提出，只有采用多个网络之间相互竞争的方式，才是将竞争引入电信产业的最好方法。The paper presents how FCC adopted UNE rule in telecommunication industry and proceeds to analyze the reason why the UNE regulation is a failure. According to the result of UNE regulation, it can be drown that promoting competition through mandatory collaboration between two competitors is too difficult to achieve. The feasible way to facilitate competition is to liberate the market forces rather than regulate the market. In the light of the failure of UNE policy, it can be concluded that the best way to introduce competition in telecommunication industry is to encourage inter - modal competition by rival networks.
