摘  要:近年来,个人代理寿险营销制度在我国得到了飞速发展,发挥了重要作用。但也存在寿险营销员法律地位模糊、经济权益保障水平偏低、社会认同度低下等弊端,其原因在于现阶段我国寿险营销员权益保障制度的缺失。借鉴保险业发达国家和地区寿险营销员权益保障的有益经验,结合我国保险业发展的实际,必须推动现行个人代理营销制度、寿险代理佣金分配制度、保险公司责任追究制度、寿险营销员诚信惩戒制度、保险中介自律机制的改革与创新,完善相关法规政策,加强社会宣传,提高寿险营销员的社会认同度,从根本上提升我国寿险营销员整体权益保障水平。Individual life insurance agent system had an exponential development in China in recent years and contributed significantly to the rapid development of the life insurance industry. However, the legal position of life insurance agents still remains undefined, protection of their economic interests is inadequate, and social recognition of them is fairly low. The root to these problems is the absence of adequate protection to agents' rights and interests. Borrowing from experiences of countries and regions where the insurance industry is better developed and insurance agents are more adequately protected, we must reform and innovate the individual agent distribution system, life insurance agent commission system, insurance company liability recourse system, life insurance agent credibility system, and insurance intermediaries self-discipline mechanism, amend relevant laws and regulations, step up efforts at social publicity and enhance social recognition of insurance agents. Only by doing so can we lift up the level of protection on the rights and interests of insurance agents in China.
