摘  要:教育机构所有权是一种“状态依存所有权,”是由于教育合约的不完备而导致的剩余产权,包括剩余索取权和剩余控制权。教育机构所有权初始安排中,相对于人力资本提供者,非人力资本提供者应该拥有更大的剩余索取权和控制权。人力资本的专用性和团队特征要求教育机构所有权的初始安排必须作出相应的调整。Ownership of educational organizations including residual claim and residual fights of control is a kind of residual property rights resulted in incomplete educational contract, it is a kind of state-contingent ownership. The different features between the human capital and the non-human capital lead to the owners of non-human capital own more residual claim and residual rights of control than the owners of the human capital in the prime arrangement, But with the increase of the specialization of the human capital and the feature of cooperation, such an arrangement will be modulated to the arrangement that ratio of residual claim and residual rights of control assigned to the owners of the human capital will be improved.
