摘  要:关于死刑的存与废的论证,无论是保留的观点还是废除的观点,其内容都已毫无生气。如果从人性角度出发,死刑就具有存在的正当性,因为死刑制度源于人类社会的人伦基础。但是,死刑存在的正当性并非等于死刑适用的正当性,存在的正当性是应然层面的认识,而适用的正当性是实然层面的认识,必须经过对死刑存在正当性的限定,死刑才会有存在的合理性。因此,以“人权规范”作为死刑存在与否的真正基础是不妥当的。The viewpoints on the justification of death penalty, no matter to retain or to abolish, have no new contents. Viewing from the perspective of human nature, the existence of death penalty is justifiable, for its capital punishment system originated from the basic ethics of human society. However, we must not mix up the justification of the existence of death penalty with the application of it - the former is recognition in a theoretical level while the latter is one in a practical level, so the rationality of existence would never be obtained if without the limitation of justification. Therefore, "human rights norm" may not be the right ground for us to discuss the justification of the existence of death penalty.
