摘　　要：《烟草控制框架公约》是世界卫生组织第一个具有国际法约束力的全球性公约,也是第一个旨在限制全球烟草和烟草制品的公约。如何解释公约、进行国内法的适用和履行公约义务是目前研究急需要解决的问题。它的职能是提高个人在现有条件下最大的健康可能,通过利用现有资源、互通有无的物质资源与信息交流,达到最大健康可能。它具有渐进性、框架议题式、缺少义务与责任条款、发展中的争议解决机构、定期的信息交流与报告机制等特点。FCTC is a first intemational construction of WHO, with the aim to restrict tobacco and tobacco consuming. How to interpret the treaty and how to fulfil the duty of the treaty is an important issue which should be solved immediately and properly in China. FCTC＇s function is to improve the health possibility in possible condition, with using the existing resourses, exchanging materials and information. FCTC has characters of improving step by step, frame style, lack of duty and resposibilty, developing dispute settling body and regular information exchange ect.
