摘 要:土地使用性质变更能产生巨大经济利益。根据经济学的一般均衡原理,近几年富人扎堆出现在房地产领域,与房地产老板获得土地开发时没有对土地发展权支付对价有很大关系。国外土地发展权成为一项独立意义的财产权,要改变土地使用类别(开发土地),必须购买土地发展权。土地使用权出让金不是土地发展权的对价;征收农民集体土地的补偿费也不包括土地发展权的对价。房地产老板开发土地,应当向原土地所有权人支付土地发展权对价。The shift of land usages may arouse vast economic profits. The general equilibrium principle in economics shows that where there are people getting rich quickly, there exist plunders. During the past few years, a great number of rich men huddled together in the field of real estate. The cause of this phenomenon has a lot to do with the nonpayment of consideration to the land development rights when those bosses get the right to develop the lands. In foreign countries, the land development rights tend to be an independent property rights. Would the usage of land be shifted, the land development rights should be purchased at first. While in China, the real estate bosses pay no consideration to the land development rights. Neither the charge of land-users nor the compensation for requisition of rural collective land contains the consideration of the land development rights.
