摘　　要：根据交易安全与快捷的价值取向和动产占有的公信理论,动产抵押权的善意取得制度的存在是必要的,动产抵押权善意得的构成要件有其特殊性,合理配置原权利人和善意第三人之间的权利和义务是动产抵押权善意取得法律效力的核心问题。In accordance with the value orientation of the safety and speediness of trade and the principle of public confidence, the innocent purchase of the mortgage on movables is essential. The constitutive requirements of the innocent purchase of the mortgage on movables is special. It is a key question of the legal effectiveness of the innocent purchase of the mortgage on movables to reasonably collocate the right and the duty between the owner of the right of disposing and bona fide third party.
