摘　　要：针对司法工作人员在司法实践中容易出现的经验主义和教条主义错误等问题,采用逻辑理论与司法实际相结合,阐述了历史和逻辑的方法相统一的辩证思维方法。对正确分析案情,完成好刑事诉讼各阶段的任务,有着十分重要的意义。In view of the empirical and doctrinal mistakes of judicial missionaries in the judicial practice and in order to enhance the logical thoughts of the judicial missionaries, the thesis sets forth the thinking way of the unification of historical and logical methods by means of combining the logical theory and judicial practice. It plays an important role in the analysis of cases and in completing the tasks in criminal cases of any stage.
