摘　　要：在买卖合同中出卖人欠缺处分权时,应将其合同认定为有效,在现有法律规范框架下按照特别法优于一般法的原则,优先适用合同法第150条关于瑕疵担保义务的规定,限定适用第51条关于无权处分合同无效的规定。The contract is deemed to be effective when the seller is without the right of disposition in commerce contract. Under the existing legal framework, according to the principle of ＂special law derogates general law＂, we should give priority to Article 150 of the Contract Law which is about the duty of defect guarantee, and limit the application of Article 51, which stipulates unauthorized disposition contract is invalid.
