摘 要:不动产物权变动的两个环节之间存在“时间差”,为房屋双重买卖的产生提供了可能。在房屋双重买卖中,三方当事人形成的法律关系十分复杂。从交易环节来看,我国房屋双重买卖大致可划分为三种情形。基于“公示要件主义”的物权公示制度是解决此类纠纷,平衡各买受人间利益的根本法律手段。因此,一是有必要澄清来自“公示对抗主义”的曲解,承认“物权行为”并吸收“分离原则”,充实我国的“物权公示”制度。二是通过比较“不动产契约公证”制度和“预告登记”制度的优劣,在不动产登记制度中设立“预告登记”制度。There are some time differences in the two steps of the immovable property real rights alteration, which provides the tenement dual sales with opportunities. In these sales, the legal relations of the triple - party is complicated. In terms of the sale course, the tenement dual sales in China can be divided into three types in the rough. The real rights declaration system which is on the principle of the creation mode of publication, is the prime legal means in settling these bothers and balancing the benefits between the buyers. Therefore, it is necessary to clarify the distortion from the defensible mode of publication, to accept the juristic act of real rights and to adopt the principle of separation for enriching the system of property publication in China. By comparing the immovable property contract notarization system with the registration of advanced notice system, the latter is indispensable to the construction of the registration system for real rights in China.
